The Delhi Forest Department recently issued a circular to reaffirm the legal definition of a “tree” under the Delhi Preservation of Trees Act (DPTA), 1994. The move aims to eliminate confusion in tree counting and management, particularly during pruning and conservation activities. This clarification follows disputes with environmental activists, where pruning operations were misinterpreted because branches were mistakenly counted as separate trees.
Legal Definition of a Tree
- Section 2(i) of the DPTA, 1994, defines a tree as follows:
- A woody plant with branches supported by a trunk or main body
- The trunk must have a minimum diameter of 5 centimetres, measured 30 centimetres above ground level
- The tree must be at least 1 metre tall from the ground
- This precise definition ensures uniformity in tree identification, counting, and legal protection.
Clarification on Counting Trees
- The circular emphasises that:
- Branches or shoots emerging from the soil should not be counted as separate trees
- Previously, species like kikar and babool, which often have multiple basal branches, were incorrectly counted as multiple trees
- Only distinct trunks meeting the legal criteria are to be counted
- This standardisation prevents inflated tree counts and ensures accurate forest data interpretation.

- Removing weak, dangerous, or undesirable branches to prevent accidents along roads, railways, and public spaces
